Visitor Agreement

Any person or entity (”User”) visiting, using or otherwise accessing the site at marpple.com, marpple.shop, ci.me, or any related website that is owned or operated by Marpple Corporation (collectively referred to as “Marpple,” the “Site,” “We,” or “Us”), or accessing any information contained on such sites, agrees to and is bound by the following terms and conditions of this Visitor Agreement (“Agreement”). By using the Site and the Service, you agree to be bound by this Agreement and to use the Site and the Service only as provided herein.

Intellectual Property Rights of Marpple

Marpple is committed to the appropriate and legal use of the intellectual property of others, and we expect our users to do the same. Unless otherwise stated, all materials appearing on the Site, including images, illustrations, designs, icons, photographs, written content, and other materials (collectively, the “Content”), are protected by copyright, trademark, trade dress, and/or other intellectual property rights owned, controlled, or licensed by Marpple.

Eligibility

Our services are available only to individuals who are legally capable of entering into binding contracts under applicable law. The minimum age required to use our Services is:

1. United Kingdom, EU member countries, and Australia: 16 years of age or older
2. All other countries and regions: 13 years of age or older

Users who meet the minimum age requirement but are under the age of 18 may use the Services only with the supervision and consent of a parent or legal guardian.

Use of Site

Generally, products created using images available on the site may not be resold for commercial purposes. If you wish to resell such products, you agree to contact Marpple and verify the legality of the resale before doing so. Designs created using the text and image tools available through the Site are not the exclusive property of the customers who create them. Marpple reserves the right to display such designs or offer them (or variations thereof) to other customers.

Additionally, Marpple reserves the sole right to reject any order that it determines to be defamatory, obscene, profane (according to standards established by the FCC), promotes irresponsible use of alcohol or other substances, advocates discrimination or persecution based on gender, age, race, religion, disability, national origin, or contains explicit sexual content, or is otherwise inappropriate for production.

You agree not to use Marpple's service to create any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, racially or ethnically offensive, or that infringes upon any patent, trademark, trade secret, copyright or other proprietary rights of any third party.

Marpple does not endorse or assume responsibility for the content of any third-party website, does not guarantee the availability of such websites, and shall not be liable for any loss or damage arising from your access to or use of such websites. Accessing any linked website is at your own risk.

Links to Us

You may link to the Site, provided that such link does not imply any endorsement by Marpple of any products, services, or content, does not misrepresent your relationship with Marpple, does not present false or misleading information about Marpple, does not infringe upon the intellectual property or other rights of any person or entity, and complies with all applicable laws and regulations. Marpple reserves the right to withdraw this permission at any time and to take any other appropriate action as its sole discretion.

User Content

You retain ownership of any content that you submit, upload, or otherwise make available through the Site. However, in order for Marpple to provide its Services, you grant Marpple a non-exclusive, worldwide, royalty-free license to use, reproduce, store, archive, display, and process such content as reasonably necessary to operate, provide, and improve the Services.

By submitting content, you represent and warrant that:

• You own the content or have obtained all rights, permissions, and authorizations necessary to use, reproduce, display, distribute, and otherwise make the content available through the Services.
• The content does not infringe or violate any intellectual property rights, privacy rights, publicity rights, or any other rights of any person or entity.
• Your use of the Services complies with all applicable laws, rules, and regulations.
• The content does not contain material that is defamatory, obscene, pornographic, indecent, harassing, threatening, harmful, abusive, invasive of privacy, discriminatory, hateful, or otherwise objectionable.
• The content does not contain viruses, malware, Trojan horses, worms, time bombs, cancelbots, or any other malicious code or software intended to damage, interfere with, disrupt, or gain unauthorized access to any system, network, data, or information.
• The content is not false, misleading, or intended to promote fraudulent products, services, schemes, or activities.

Marpple reserves the right, but is not obligated, to review, remove, restrict, disable access to, or refuse any content that it determines, in its sole discretion, violates these Terms, applicable laws, or the rights of any third party. Marpple may also suspend of terminate you account for such violations.

You agree to indemnify and hold harmless Marpple, its affiliates, officers, directors, employees, and agents from an against any claims, liabilities, damages, losses, costs, or expenses arising out of or relating to your content, your use of the Services, or your violation of these Terms or applicable law.

Intellectual Property Rights and License

By submitting, uploading, posting, or otherwise making content available on Marpple, you grant Marpple a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, create derivative works from, display, and otherwise utilize such content in connection with the operation, promotion, improvement, and provision of the Services.

The license includes the rights for Marpple to promote and redistribute all or part of the Site and its related services through any media format and distribution channel.

You also grant users of Marpple a non-exclusive license to access, view, reproduce, distribute, and display your content as permitted through the functionality of the Services and these Terms.

Except for content contained in user comments, the licenses granted above will terminate within a commercially reasonable period after you remove or delete the applicable content from Marpple. Licenses granted in connection with user comments may continue on a perpetual and irrevocable basis.

All intellectual property rights in and relating to Marpple and its Services, including but not limited to the software, systems, text, graphics, logos, icons, audio recordings, images, and other materials, are owned by or licensed to Marpple and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms or applicable law, you may not:

• Use, modify, adapt, reproduce, store, distribute, publish, display, perform, or create derivative works from any portion of the Site or Services.
• Commercialize, sell, license, or otherwise exploit any information, products, services or materials obtained through the Site or Services without prior written permission from Marpple

If you reference any trademarks owned by Marpple, you must clearly acknowledge Marpple’s ownership of that trademark.

You may not use any Marpple trademark:

• As all or part of your own trademark, brand name, or service name
• In connection with products, services, or activities that are not provided by Marpple
• In any manner that is likely to cause confusion, mislead users, or imply sponsorship, endorsement, or affiliation where none exists.
• In any manner that disparages, damages, or harms the reputation of Marpple, its Services, products, or content.

Reporting Inappropriate Content

Marpple does not routinely review or pre-screen content before it is published on the Site. As a result, users may occasionally upload or display content that violates these Terms or applicable laws.

Prohibited content includes, but is not limited to, content that infringes the intellectual property of others, is defamatory, obscene, pornographic, indecent, harassing, threatening, harmful, abusive, invasive of privacy or publicity rights, discriminatory, hateful, or otherwise objectionable.

While Marpple reserves the right, at its sole discretion, to remove, restrict, edit, or disable access to such content, Marpple is under no obligation to monitor or review user-generated content on an ongoing basis.

If you encounter content that may violate these Terms or applicable law, please report it to us promptly. If you believe your copyright or other intellectual rights have been infringed, you may submit a formal complaint to info@marpple.com.

Shipping and Delivery

Orders placed through Marpple are generally delivered within 14 days. However, delivery times may vary depending on product availability, destination, carrier conditions, seasonal demand, or other circumstances beyond our reasonable control.

If you have a time-sensitive order, we recommend contacting Customer Support before placing your order.

Return and Refund Policy

Marpple strives to fulfill all orders accurately, promptly, and to a high standard of quality. Refunds or replacements may be provided when a product fails to meet reasonable quality standards or does not materially match the approved order details. Eligible situations may include:

• The product itself contains a material defect or manufacturing flaw.
• The print, embroidery, or other customization quality falls below reasonable expectations.
• The delivered product differs materially from the design or specifications approved by the customer.

Requests for refunds, replacements, or other remedies are subject to review by Marpple and must comply with our applicable return and refund procedures.

Damaged Goods

If a product is delivered in a damaged or defective condition, whether in physical or digital form (including, but not limited to, misprints, damaged frames, or missing or loose components), Marpple may, upon receiving reasonable proof of the damage, contact the applicable manufacturer or seller to arrange for a replacement.

Live Streaming

1. Operations of the Living Streaming Service

Marpple provides a live streaming platform that enables users to broadcast and watch live streams, participate in chat, send donations, subscribe to channels, and use other related features. Marpple is solely the provider of the platform and is not a party to any legal relationship or transaction between streamers and viewers. To maintain and improve the Services, Marpple may modify, add, suspend, or discontinue any part of the Live Streaming Service at any time. Although Marpple may provide features such as VOD storage or backup, these features are offered solely as a convenience. Marpple does not guarantee the permanent storage, preservation, or recovery of any content.

Because live streaming is provided in real time, broadcasts may experience latency, interruptions, reduced quality, or other technical issues due to server conditions, network connectivity, hardware limitations, or other factors beyond our reasonable control. From time to time, Marpple may introduce experimental or beta features. These features are provided on an "as available" basis, and Marpple makes no guarantee regarding their stability, availability, or continued support.

If a user violates these Terms or the applicable Community Guidelines while using the Live Streaming Service, Marpple may take appropriate enforcement action, including restricting or suspending access to all accounts reasonably determined to belong to the same user. To protect the identity of established creators, Marpple may maintain a nickname protection policy for streamers who have achieved a certain level of activity or recognition on other platforms. Eligibility requirements and protection procedures are governed by the applicable operating policies. If an existing user's nickname becomes subject to this policy, Marpple will provide prior notice and allow a seven day objection period. If any objection submitted during that period is not accepted based on reasonable grounds, Marpple may change the user's nickname.

2. Responsibility for Content

Each streamer is solely responsible for the content they create, broadcast, upload, or otherwise make available through the Live Streaming Service. Marpple does not pre-screen and has no obligation to continuously monitor or supervise content provided by streamers. Accordingly, Marpple is not responsible for any content published through the Live Streaming Service.

Marpple makes no representations or warranties regarding the legality, accuracy, completeness, quality, availability, or fitness for any particular purpose of content made available through the Live Streaming Service. In the case that content violates, or is reasonably suspected of violating, applicable law, these Terms, or the Community Guidelines, Marpple may, without prior notice, restrict its visibility, remove the content, suspend the applicable account, or take any other enforcement action deemed appropriate, taking into account the real-time nature of the Live Streaming Service.

3. Chat

Users are solely responsible for all chat messages, nicknames, emoticons, and any other information they create, submit, or display through the Live Streaming Service. Marpple is not responsible for user-generated chat content. If chat content violates applicable law, these terms, or the Community Guidelines, Marpple may delete, edit, restrict, or otherwise limit the visibility of such content.

To maintain a safe and healthy community, Marpple may block, remove, restrict, or otherwise moderate chat messages without prior notice. Because chat messages are real-time communications rather than permanent user posts, moderation actions taken after a message has been transmitted may not always prevent harm of fully protect the rights of other users.

4. Donations

Donations are a feature that allows viewers to voluntarily provide financial support to streamers through tools made available by Marpple. Except where required by applicable law, donations become effective immediately upon payment and are non-refundable. They are voluntary payments made at the viewer’s discretion and are not subject to cancellation or withdrawal rights.

A donation does not create any contractual obligation between the viewer and the streamer. Responsibility for how donations are used, acknowledged, or otherwise handled rests solely with the viewer and the streamer. Marpple is not responsible for disputes arising from donations except where required by applicable law. Marpple may modify the available donation features, payment methods, usage rules, or related operating policies from time to time as necessary for the operation of the Services.

5. Subscriptions and Gift Subscriptions

Subscriptions allow users to access benefits provided by the Service or offered by individual streamers for specific channels. Channel-specific benefits, including custom emoticons and other subscriber perks, are managed solely by the channel owner. Except when required by applicable law or caused by Marpple’s willful misconduct or negligence, Marpple is not responsible for the availability for the availability or operation of such benefits.

Subscriptions are offered in two forms:

1. Recurring Subscriptions: renew automatically each billing period
2. Fixed-Term Subscriptions: purchased as a one-time subscription for a specified duration

Recurring Subscriptions will automatically renew using your designated payment on the day following the end of the current subscription period. Subscriptions are personal to the purchasing user and may not be transferred, assigned, or shared with another user or account. If you cancel a Recurring Subscription, future renewal payments will stop, and your subscription will remain active until the end of the current billing period.

Except when otherwise required by applicable law, subscription refunds are subject to Marpple’s refund policy and must be requested through Customer Support or other designated refund channels.

• If a refund is requested within seven (7) days of purchase, the remaining subscription period will be refunded on a prorated basis.
• If a refund is requested more than seven (7) days after purchase, the unused portion will be calculated on a prorated basis, and a 10% cancellation fee will be deducted from the refund amount.
• Purchases made through an app marketplace are subject to that marketplace’s applicable refund policy.

Gift subscriptions become effective immediately upon purchase and, except where required by applicable law, are non-refundable and may not be cancelled. If a subscribed channel is deleted, suspended, or otherwise becomes unavailable due to actions affecting the channel, any active Recurring Subscription for that channel will be cancelled automatically. If you are banned from a subscribed channel, your Recurring Subscription will remain active. You may still cancel future renewals or request a refund for any remaining subscription period in accordance with these Terms. If you later wish to subscribe to that channel again after cancelling or receiving a refund, the channel owner or moderator must first remove your ban.

If you delete your Marpple account, any active Recurring Subscription will be cancelled automatically. Before deleting your account, you may request a refund for any remaining subscription period in accordance with these Terms. Once your account has been permanently deleted, all subscription-related information will also be permanently deleted and cannot be recovered.

6. Clips

Clips are short videos created by streamers or other users using the clipping tools provided by CIME. Users may create Clips only from content that the streamer has made available for clipping and only through the features provided by the service. Clips may be shared only through the official sharing methods supported by CIME. Any other distribution, reproduction, or external use is prohibited unless otherwise permitted by the applicable rights holder.

All rights to the original content used in a Clip remain with the streamer. Users may not commercially exploit Clips. If a Clip generates revenue, such revenue may belong to the streamer. Users may not create Clips that misrepresent the original content or infringe the intellectual property, privacy, publicity, or other rights of the streamer or any third party. Users are solely responsible for the creation and use of their Clips. Except as required by applicable law, Marpple is not responsible for any Clips created or shared by users. Clips may be displayed, promoted, or otherwise made available through the Service or third-party service.

Cancellation Policy

You may modify or cancel your order within twenty-four (24) hours after it has been placed.

Unauthorized Access and Misuse

You agree not to interfere with the operation or security of the Site, including by attempting to hack, gain unauthorized access to, reverse engineer, disrupt, overload, or otherwise compromise the Site or its Services. You are responsible for any damages from your unauthorized activities and agree to indemnify Marpple for any losses arising from such conduct. Marpple reserves the right to investigate suspected violations and may cooperate with law enforcement authorities in connection with any unlawful activity involving the Site or the Services. Marpple may, at its sole discretion and without prior notice, suspend or terminate your access to the Site or Services, block your IP address, or take any other action it considers appropriate to protect the Site, its users, or its business. Marpple reserves all rights and remedies available under applicable law with respect to any violation of these Terms.

Marketing and Retargeting

Marpple provides users with the ability to run retargeting campaigns through the Marketing section of the dashboard. These campaigns allow you to retarget consumers based on data collected through the Marpple platform. To provide this functionality, Marpple works with Unite and its partners, including Google and AppNexus, to collect and manage the relevant data and deliver targeted advertisements on third-party websites across the Internet. By using Marpple's marketing and retargeting features, you agree that, in addition to these Terms, your use of these features is subject to the applicable policies of the third-party providers, including the AppNexus Platform Privacy Policy. You also acknowledge and agree that Marpple, Unite, and/or AppNexus may include an opt-out mechanism within your advertisements where required or permitted.

If you believe that any content available through the Services infringes your copyright or other intellectual property rights, or otherwise violates your legal rights, please contact us at info@marpple.com.

Trade Marks

Unless otherwise stated, all trademarks, service marks, trade names, logos, and branding used on the Site, including Marpple, are owned by Marpple or its licensors. You may not use, reproduce, distribute, or otherwise exploit any Marpple trademarks or trade names without Marpple’s prior written permission.

Registration

By registering for an account, you agree to:

• Comply with these Terms and any applicable Registered User Agreement.
• Maintain the security and confidentiality of your account credentials and not permit any other person to access your account.
• Not assist any unauthrorized person in accessing restricted areas of the Site or Services.
• Not create multiple accounts to abuse the Services, circumvent restrictions, or impersonate another user.

Limitation of Liability

To the fullest extent permitted by applicable law, Marpple's total liability arising out of or relating to these Terms or the Services shall not exceed the greater of (i) the total amount you have paid to Marpple for the applicable Services, or (ii) USD $100. Nothing in these Terms limits or excludes liability for death or personal injury caused by Marpple's negligence, or any other liability that cannot be limited or excluded under applicable law.

Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference, to learn how Marpple collects, uses, and protects your personal information.

Security

While Marpple takes reasonable measures to protect your information, no method of transmission or storage over the Internet is completely secure. You acknowledge that any information you transmit to Marpple is provided at your own risk.

Termination of Access

Marpple may suspend or terminate your access to the Site or Services at any time, with or without notice. Any provisions of these Terms that by their nature should survive termination will remain in effect.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

Changes to these Terms

Marpple may update these Terms from time to time without prior notice. Any changes become effective when posted on the Site. Your continued use of the Site or Services after the revised Terms are posted constitutes your acceptance of those changes.

Indemnification

You agree to defend, indemnify, and hold harmless Marpple, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site or Services, your violation of these Terms, or your infringement of any third-party rights.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea.
